Court renders judgment in first instance
On 20 September 2023, the District Court of The Hague handed down its judgment in the collective action against Airbus, its responsible executives and auditors. The action was initiated by Stichting Investor Loss Compensation on behalf of institutional and retail investors to recover losses incurred as a result of Airbus’ involvement in bribery and misconduct. The losses amount to more than EUR 300 million.

In its judgment, the court accepted jurisdiction over the majority of the Foundation’s claims and determined that the Foundation was sufficiently representative to represent the interests of the investors. However, the court ruled that certain elements of the Foundation’s governance were inadequate and therefore declared the Foundation inadmissible. The judgment can be found here.

The Foundation is currently addressing the concerns raised by the court and will be appealing this decision shortly. Therium, the third party litigation funder, has confirmed its financial commitment to fund this appeal. The Foundation will continue to promote the interests of investors in this matter and will take all necessary steps to obtain compensation for the damage caused by Airbus, its responsible executives and auditors.

Investors who are registered with the Foundation do not need to take any action at this stage and will be updated in due course.
