On 24 September 2024, the Foundation filed its statement of defense in cross appeal. In this document, the Foundation responded to the grounds raised by Airbus, its responsible executives and auditor against the judgment. These mainly concerned the applicable collective action law and the jurisdiction of the Dutch court, but also a number of points concerning the admissibility of the Foundation.
