Since the establishment of the Foundation, Christoph Kuzaj has served on the Supervisory Board as a representative of litigation funder Therium. This is in accordance with the Claim Code 2019 and Christoph Kuzaj has consistently acted within the scope and parameters of the Claim Code. The Foundation has consistently maintained full transparency regarding Christoph Kuzaj’s role at Therium.
While the Foundation and Christoph Kuzaj continue to consider his role to be valuable to the Foundation, they have jointly decided that it is in the best interests of the Foundation for him to resign as a member of the Supervisory Board. Therium did not nominate another candidate.
The Foundation has found Pieter Schuurs willing to join the Supervisory Board and he has also taken over the role of Chairman from Karl Peter Puszkajler.
Pieter Schuurs has a substantial background in the financial sector, with a particular focus on securities. He has held senior roles at banks, a major Dutch asset manager and at securities and commodity exchanges, including as managing director of the Amsterdam Stock Exchange and the Dutch CSD. He has also served as COO and CEO of energy exchanges APX-ENDEX and ICE Endex, and chaired Europex, the European association representing the interests of European energy exchanges. His experience makes him an excellent expert on (the dynamics of) stock markets. Until mid-2021, Pieter served as vice chairman of the supervisory board of the European investors organization (the VEB) and chairman of its legal committee until mid-2021. This committee was responsible for preparing all decisions made by the supervisory board of the VEB that involved legal proceedings, approving strategic decisions and determining whether to accept settlements. Pieter is a member of the Securities & Markets Stakeholder Group of ESMA, the European financial regulator. Additionally, he serves on the board of SCTB, the Dutch foundation that represents the interests of investors in Triodos Bank. The subject-matter of the proceedings against Airbus (the disclosure requirements of listed companies and the market’s reaction to them) and the collective nature of the proceedings align very well with Pieter’s experience and expertise, as he represents the interests of both private investors and the subject matter of the proceedings.
